Terms of sale

Article 1: Scope

These General Terms and Conditions of Sale apply exclusively to all current and future commercial relations between the purchaser and Magie Factory, PARC GIRONDE SYNERGIE 1, AGORA, 33820 SAINT-AUBIN-DE-BLAYE, FRANCE.
Any condition that does not comply with these terms and that you may propose will be rejected unless expressly and formally accepted in writing by us.

We reserve the right to amend these General Terms and Conditions of Sale at any time, provided such modifications appear on our website.

Article 2: Orders

We undertake to accept your order under the terms set out in these General Terms and Conditions of Sale.

When the consumer clicks the “confirm” button or link, they are irrevocably bound by their order. This acceptance may only be challenged under the conditions stated in Article 8.

Please note that orders are processed subject to our available stock or availability from our suppliers.

If, despite our vigilance, products become temporarily unavailable (out of stock, reprints, etc.), we will notify you by email and invite you to cancel or modify your order. If products become permanently unavailable (out of print, discontinued, etc.) after the order is placed, we will automatically cancel the order and notify you by email.

By confirming your order, you accept the entirety of these General Terms and Conditions of Sale made available on the website and acknowledge full understanding of them, thereby waiving the right to rely on any contradictory document, including your own purchase terms. This confirmation, along with all data recorded by us, will constitute proof of the transaction.

Article 3: Prices

Prices are indicated in euros, including VAT at 20% for all products and 5.5% for books.
Shipping costs will be added to the total of your order. For deliveries outside the European Union, customs duties and related formalities remain the exclusive responsibility of the consumer, who must check compliance with local import requirements.

We reserve the right to modify our prices at any time, but we agree to apply the prices in effect at the time your order is placed.

VAT – Automatic Detection & Intra-EU VAT

Our website automatically detects the customer’s connection country and/or delivery address to display the applicable VAT and pricing:

  • Customers in the European Union (EU): French VAT is applied by default, unless the customer provides a valid intra-EU VAT number, in which case VAT will be automatically deducted in accordance with applicable law (reverse charge mechanism under Article 283-2 of the French Tax Code).

  • Customers outside the EU: VAT is automatically deducted at checkout. Local taxes or customs duties may be applied by the destination country (at the customer’s expense).

The customer may enter their intra-EU VAT number during checkout so that the system applies the correct tax treatment automatically.

Article 4: Payment

The order price is due immediately on the order date.

Customers residing in mainland France or Belgium may pay by credit card (via PayPal), PayPal, Alma, or cheque.

Online credit card payments are fully secure: SSL encryption ensures transmitted information cannot be read during transfer.

Credit card numbers transmitted to us are not stored in any database. They remain linked only to the invoice.

The customer certifies having the necessary authorizations to use the chosen payment method. In the case of credit card payments, the payment order may be revoked in the event of fraudulent use of the card under the terms of the agreement between the customer and their bank.

Article 5: Delivery

Unless otherwise stated, delivery is made to the address provided at checkout.
Risk transfers to the customer once the goods have left our premises. Delivery times are indicative only.

Home delivery is provided. Delivery time includes order preparation plus transport time. Average delivery times are:
• 3 days within metropolitan France
• 5 days within Europe
• 9 days outside the EU
These are not guaranteed deadlines, and Magie Factory cannot be held liable for delays.

Article 6 – Right of Withdrawal & Return Conditions

6.1 – Legal Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has fourteen (14) days from receipt of the product to exercise their right of withdrawal without providing justification.

Access to digital content – Exclusion of the right to refund

In the context of the sale of products including access to digital content (in particular explanatory videos, tutorials, training courses, or any other dematerialized content), the Customer is informed that:

• Access to this content is strictly personal, confidential, and protected. • Once the digital content has been viewed, in whole or in part, the product in question is deemed to have been used.

• Consequently, no refunds, exchanges, or returns will be accepted, even if the associated physical product has not been used, opened, or unsealed.
In accordance with Article L221-28 of the French Consumer Code, the Customer expressly acknowledges that access to digital content results in the loss of the right of withdrawal where applicable.

This provision applies to all Customers, including orders shipped outside the European Union, regardless of any local rules that may apply.

6.2 – Product Return

Once the withdrawal request has been made, the customer has fourteen (14) additional days to return the product.

Return shipping costs remain the responsibility of the customer.

6.3 – Condition of the Returned Product

To qualify for a withdrawal or accepted return, products must be returned:

  • new,

  • complete,

  • clean,

  • unused,

  • in their original intact packaging,

  • and suitable for resale as new.

Any product returned incomplete, damaged, used, dirty, or with deteriorated packaging may result in:

  • a partial refund corresponding to the depreciation, or

  • a refusal of refund if the product can no longer be resold.

Magie Factory reserves the right to refuse a return if these conditions are not met.

6.4 – Products Excluded from Withdrawal

Under Article L221-28 of the French Consumer Code, certain products cannot be returned, including:

  • personalized products,

  • digital content provided without physical support once execution has begun with customer consent,

  • unsealed products that cannot be returned for hygiene or health protection reasons.

No refund may be issued for such items.

6.5 – Refund

If the withdrawal is exercised in compliance with the above conditions, Magie Factory will refund the price of the returned products within a maximum of fourteen (14) days after receiving the products in good condition.

Refunds are made using the same payment method used at the time of purchase.

Article 7: Retention of Title

Delivered goods remain our property until full payment has been made, including any applicable interest.
This retention of title does not affect the transfer of risk, which passes to the customer once the goods have left our premises (Article 5).

Article 8: Hidden Defects & Liability

If the delivered products show a hidden defect, the customer has fifteen (15) days to return them. Return shipping costs will be compensated with a store credit of equal value.

We may, at our discretion, repair the defect or replace the defective product. If we decline or are unable to do so within reasonable time due to circumstances beyond our control, the customer may return the product for a refund (including return costs) or request a price reduction.

Products comply with French legislation. We decline responsibility if the product does not comply with local laws in the destination country.

We are not responsible for content on third-party websites accessible via hyperlinks.

We undertake to provide professional diligence; however, we cannot be held liable in cases of force majeure (natural disasters, strikes, fires, floods, equipment failure, transport or communication issues, or customer actions).

We are also not liable for delays caused by supplier stock shortages or inaccuracies in product presentation (photos, descriptions, and illustrations are non-contractual).

Article 9 – Commercial Warranty & After-Sales Service (LA MALLETTE)

The Magie Factory suitcase benefits from a six-month (6) commercial warranty covering manufacturing defects under normal use.
This commercial warranty is distinct from legal warranties of conformity and hidden defects.

9.1 – Covered Defects

Covers notably:

  • abnormal stitching defects or unusual structural failures

  • zipper malfunction without misuse

  • structural collapse or deformation not caused by overloading

  • manufacturing defects occurring during early use

9.2 – Exclusions

Not covered:

  • normal interior or exterior wear

  • tears, impacts, crushing, dents, dirt

  • cosmetic damage (scratches, stains, abrasions…)

  • deformation due to overloading or improper transport

  • forced zippers or improper use

  • clearly worn or excessively used products

  • any repair or modification by an unauthorized third party

9.3 – Mandatory Procedure Before Any Return

Before authorizing a return, the customer must provide photos from multiple angles (inside, outside, zipper, affected areas).
Without these photos, Magie Factory cannot assess or authorize a return.

9.4 – Possible Solutions

If the defect is covered, Magie Factory may offer:

  • repair,

  • replacement with a new or equivalent product,

  • or any other equivalent solution at its discretion.

9.5 – Non-Covered Products

If not eligible for warranty, Magie Factory may, as a goodwill gesture:

  • offer a new suitcase with an exceptional discount, or

  • offer a paid repair option when feasible.

9.6 – Proof of Purchase & Authentication

The customer must provide proof of purchase and, if applicable, the warranty card number.

Article 10: Personal Data Protection

We are committed to protecting your personal data. All personal information collected is processed confidentially in accordance with our privacy policy.
We only request the information necessary for order processing.

We do not sell, rent or trade this information to third parties.

Under Article 27 of the French Data Protection Act (6 January 1978), you have the right to access and rectify your personal data.

By accepting these terms, you acknowledge having read our privacy policy and consent to the collection and use of your data.

Article 11: Governing Law & Jurisdiction

These Terms are governed by French law and the Vienna Convention on Contracts for the International Sale of Goods, excluding UN sales law.
Any dispute shall be subject to the exclusive jurisdiction of the Commercial Court of Bordeaux.

Article 12: Technical Security

The “Magie Factory” website uses an external secure banking service employing cryptographic technology.
All card purchases are processed on a secure page; payment data (credit card numbers, etc.) does not transit through or remain stored on our site.

Article 13: Copyright & Intellectual Property

All elements of this website—including its structure, components, and software—are protected by French intellectual property law.
Any unauthorized use, reproduction or modification is prohibited and may result in legal action (Articles L332-4, L335-1, L335-2, L335-5 of the French Intellectual Property Code).

Counterfeiting is punishable in France by up to 2 years imprisonment and a €150,000 fine.
Courts may also order the temporary or permanent closure of establishments involved.

Article 14 – Cancellation Policy for Specific Purchase Options

Certain specific purchase options may apply, notably pre-orders.
Magie Factory does not offer subscriptions or “try before you buy” programs.

1. Pre-Orders

Pre-orders allow customers to reserve a product not yet available.
By placing a pre-order, the customer acknowledges that:

  • the product is not yet in stock;

  • the delivery timeframe is an estimate;

  • payment (full or partial) reserves the desired quantity.

1.1 – Pre-Order Payment

Depending on the product, Magie Factory may:

  • require full payment at pre-order, or

  • collect a deposit and charge the remaining balance prior to shipment.

1.2 – Modification or Cancellation

A pre-order may be cancelled as long as production or logistical preparation has not begun.

Once production or processing is underway, cancellation is no longer possible, though the customer retains withdrawal rights (Article 6).

1.3 – Delays

In the event of delays or circumstances beyond our control, Magie Factory will inform the customer, who may:

  • confirm the pre-order, or

  • request a full refund.

1.4 – Returns

Pre-orders follow the same return and withdrawal conditions as other products (see Article 6).
