General Terms and Conditions of Sale for products sold on www.magie-factory.fr

Article 1 – Purpose

These terms govern the sale of products by the company Magie Factory, whose registered office is located at PARC GIRONDE SYNERGIE 1, AGORA – 33820 SAINT-AUBIN-DE-BLAYE – FRANCE, via the website www.magie-factory.fr.

Any order placed on the website implies full and unconditional acceptance of these General Terms and Conditions of Sale, without exception or reservation.

Article 2 – Prices

The prices of our products are indicated in euros, including all taxes (VAT and any other applicable taxes on the day of the order), unless otherwise stated, and excluding handling and shipping costs.

For orders placed to a country other than mainland France, you are the importer of the products concerned. Customs duties, local taxes, import duties or state taxes may be payable. These duties and amounts do not fall under the responsibility of Magie Factory and remain entirely at your charge, both in terms of declarations and payments to the competent authorities of your country. We recommend that you obtain information from your local authorities regarding these matters.

All orders, regardless of their origin, must be paid in euros.

Magie Factory reserves the right to modify its prices at any time; however, products will be invoiced on the basis of the price in force at the time the order is confirmed and subject to availability.

The products remain the property of Magie Factory until full payment of the price has been received.
As soon as you physically take possession of the ordered products, the risk of loss or damage is transferred to you.

Magie Factory reserves the right not to register a payment and not to confirm an order for any legitimate reason, in particular in the event of a supply problem or difficulty related to the order received (suspected fraud, incomplete contact details, etc.).

Article 4 – Validation of your order

Any order placed on the website www.magie-factory.fr implies acceptance of these General Terms and Conditions.

Any order confirmation implies your full and complete acceptance of these terms, without exception or reservation.

All data provided, together with the recorded confirmation, will constitute proof of the transaction. You acknowledge that you are fully aware of this.

The order confirmation shall be deemed to constitute a signature and acceptance of the operations carried out.

Article 5 – Payment

Validation of your order implies the obligation to pay the indicated price.

Payment for your purchases is made:

  • by bank card via a secure payment solution (such as Stripe or PayPal),

  • by PayPal account,

  • and, where applicable, via instalment payment solutions (such as Alma), when such options are offered at checkout.

The card is debited at the time the order is placed, unless otherwise stated on the website (e.g. in the case of pre-orders).

Article 6 – Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, you have a period of 14 days from receipt of your products to exercise your right of withdrawal, without having to provide any reason and without incurring any penalties.

Products must be returned in their original condition and complete (packaging, accessories, instructions), clean, unused and suitable for resale as new. In this context, your liability may be incurred. Any damage suffered by the product may be grounds to refuse the right of withdrawal.

Return shipping costs are at your expense.

If the right of withdrawal is exercised within the timeframe and under the conditions set out above, Magie Factory will refund the amounts paid within 14 days of receiving the returned products or proof of shipment, whichever occurs first.

Exceptions to the right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to:

  • the supply of goods made to the consumer’s specifications or clearly personalized;

  • the supply of goods which are liable to deteriorate or expire rapidly;

  • the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

  • the supply of digital content not provided on a tangible medium, the performance of which has begun with the consumer’s prior express consent and express waiver of their right of withdrawal.

Article 7 – Availability

Our products are offered as long as they are visible on the website www.magie-factory.fr and subject to available stocks.

For products that are not in stock, our offers are subject to availability from our suppliers.

If a product becomes unavailable after an order has been placed, we will inform you by email. The order for the product concerned may then be cancelled and you will be refunded, or modified with your agreement.

Article 8 – Delivery

Products are delivered to the delivery address indicated during the ordering process, within the timeframe indicated on the order confirmation page.

In the event of a delay in dispatch, you will be notified by email of any impact on the indicated delivery time.

In the event of a delivery delay, you may, under the conditions provided for by the French Consumer Code, cancel the order. If you nevertheless receive the product, we will proceed with its refund under the legal conditions, after the product has been returned.

In the case of delivery by a carrier, Magie Factory cannot be held liable for a delay in delivery solely due to the customer’s unavailability after several appointment proposals.

Article 9 – Warranty

All our products benefit from the legal warranties of conformity and hidden defects, as provided for by Articles L217-4 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.

In the event of non-conformity or defect, the product may be returned, exchanged or refunded in accordance with the applicable legislation.

All claims, requests for exchange or refund must be made via the contact form available on the website, within a reasonable period from the date of delivery.

Products must be returned to us in the condition in which you received them, together with all components (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed on the basis of the invoiced rate and return costs may be covered under the conditions provided by law.

Article 10 – Liability

The products offered comply with French legislation in force. Magie Factory cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products you intend to order.

Magie Factory cannot be held liable for any damage resulting from misuse of the purchased product.

Furthermore, Magie Factory shall not be held liable for any inconvenience or damage inherent to the use of the Internet, in particular service interruption, external intrusion or the presence of computer viruses.

Article 11 – Applicable law and jurisdiction

The language of this contract is French.
These terms of sale are subject to French law.

In the event of a dispute, the competent courts shall be those within the jurisdiction of the Bordeaux Court of Appeal, and in particular the Commercial Court of Bordeaux where permitted by law.

Article 12 – Intellectual property

All elements of the website www.magie-factory.fr are and remain the intellectual and exclusive property of Magie Factory.

No one is authorized to reproduce, exploit, redistribute or use, in any capacity whatsoever, even partially, any elements of the site, whether software, visual or audio, without the prior written authorization of Magie Factory.

Any simple or hypertext link is strictly prohibited without the prior express written consent of Magie Factory.

Article 13 – Personal data

Magie Factory reserves the right to collect personal data concerning you. This data is necessary for the management of your orders and for the improvement of the services offered.

It may be transmitted to service providers responsible for executing orders (transport, payment, etc.).

This information is stored in compliance with the regulations in force regarding personal data protection. You have a right of access, rectification, restriction and objection with respect to data concerning you, which you can exercise by contacting us using the contact details indicated above.

Article 14 – Archiving – Proof

Magie Factory will archive purchase orders and invoices on a reliable and durable medium constituting a true copy, in accordance with the legislation in force.

The computerized records of Magie Factory will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
